Federal Trade Commission

About FTC

The Federal Trade Commission (FTC) is an independent U.S. government agency that promotes competition and protects consumers by enforcing federal antitrust and consumer protection laws. It investigates and challenges anticompetitive mergers and conduct, and combats deceptive or unfair business practices across industries.

For the chemicals and materials sector, the FTC reviews mergers and acquisitions under the Hart-Scott-Rodino (HSR) Act and can require divestitures or block transactions to preserve competition in markets such as basic chemicals, specialty chemicals, plastics, and downstream products. It also oversees advertising and environmental marketing claims—guided by its Green Guides—helping ensure claims like “recyclable,” “biodegradable,” or “non-toxic” are truthful and substantiated. The agency coordinates with the U.S. Department of Justice and state attorneys general, issues policy guidance and studies, and pursues enforcement actions to deter price fixing, bid rigging, exclusionary conduct, and deceptive marketing that could affect chemical producers, distributors, and end markets.
